More drama with Hawthorne Heights vs. Victory

By now you've heard that Hawthorne Heights publicly ended their deal with record label Victory. Although Hawthrone Heights had not yet fulfilled the terms of their contract with the label, they decided it was time to go anyway, unhappy with how their independent label was handling their affairs.

And now, for the twist!

Victory has filed suit with EMI and Virgin Records for attempting to sign the band while they're still under contract. Apparently, Jason Flom, the president of Virgin Records, along with Jason Kempler, head of business affairs, advised Hawthorne Heights to file suit with Victory to get out of their contract and go to Virgin. Hawthorne Heights already inked a deal with Virgin, which came to Victory's attention in September.

Tony Brummel is asking for $20 million to settle the suit, 10 for 'damages' and another 10 for...more damages.

EMI says they don't think anything will come from this lawsuit due to some legal mumbo jumbo loop holes.
